Welcome to faser.app! These Terms of Service ("ToS") govern your use of the faser.app platform ("the App") and apply to all users aged 13 and older. By accessing or using the App, you agree to be bound by these Terms of Service. If you do not agree, please do not use the App.


1. User Eligibility and Account

1.1 Age Requirement

The App is available only to users who are 13 years of age or older. Users below this age are not permitted to create an account or use the App's services.

1.2 Parental Consent

Users between the ages of 13 and 18 must have parental or legal guardian consent to use the App. It is the responsibility of the parents or guardians to monitor their child's use of the App.

1.3 Age Confirmation

By using the App, you confirm that you are at least 13 years old or have the consent of a parent or legal guardian. You may be required to provide proof of your age or consent if requested.

1.4 Account Creation

To access certain features of the App, you may need to create a user account. You agree to provide accurate, current, and complete information during the registration process.

1.5 Account Security

You are responsible for maintaining the confidentiality of your password and for any activities that occur under your account. You should notify us immediately of any unauthorized use of your account.

1.6 User Responsibilities

Users are responsible for maintaining the accuracy of their information and ensuring their account credentials remain secure. It is your responsibility to update your information if there are any changes.

1.7 Account Suspension or Termination

We reserve the right to suspend or terminate your account at any time, without notice, if you violate these Terms of Service or engage in any behavior that we consider harmful to other users or the App.

1.8 Voluntary Account Termination

You may terminate your account at any time by contacting us. Upon termination, you will no longer have access to your account or any content stored on the App.


2. Code of Conduct

2.1 Appropriate Use

You agree not to use the App to post any unlawful, offensive, abusive, defamatory, obscene, or otherwise inappropriate content. Content that violates the rights of others or applicable laws is strictly prohibited.

2.2 Intellectual Property Rights

You may not upload content that is copyrighted or that infringes on the intellectual property rights of others unless you have the necessary rights or permissions. Violating this rule may result in account suspension.

2.3 Prohibited Behavior

Bullying, stalking, threats, hate speech, or discrimination based on race, religion, gender, sexual orientation, or any other protected characteristic is strictly prohibited and will result in immediate action against the offending account.


3. Content and Intellectual Property

3.1 Ownership of Content

All content you upload or share on the App remains your property. However, by uploading content, you grant us a non-exclusive, worldwide, royalty-free right to use that content in connection with the operation of the App.

3.2 Content Removal

We reserve the right to remove any content that violates these Terms of Service, including content that we determine to be offensive, harmful, or inappropriate for the platform.

3.3 License to Use Content

By posting content on the App, you grant us a license to use, modify, and display your content for the purposes of operating, promoting, and improving the App. This license ends when you remove your content or delete your account.


4. Payment and Subscriptions

4.1 Subscription Fees

If you choose to purchase a subscription, you agree to pay the fees specified for the selected subscription plan. Fees are billed in advance.

4.2 Automatic Renewal

Subscriptions will automatically renew unless canceled prior to the renewal date. You can manage your subscription and cancel it through your account settings.

4.3 Right of Withdrawal

If you are a consumer within the meaning of § 13 BGB (German Civil Code), you have the right to withdraw from a paid subscription contract within 14 days without giving any reason. The withdrawal period is 14 days from the day of the conclusion of the contract. To exercise your right of withdrawal, you must inform us by email at support@faser.app of your decision to withdraw from this contract. The withdrawal does not apply to digital content that you have already consumed during the withdrawal period.

4.4 Refund Policy

Refunds are handled in accordance with applicable law. If you experience issues with your subscription, please contact us for assistance.


5. Privacy and Data Security

5.1 Data Collection

Our Privacy Policy outlines how we collect, use, and protect your personal data. By using the App, you agree to the collection and use of your data in accordance with our Privacy Policy.

5.2 Security Measures

We implement reasonable security measures to protect your data. However, no internet-based service is completely secure, and we cannot guarantee absolute security. It is your responsibility to protect your account credentials.


6. Third-Party Services

6.1 Links to External Services

The App may contain links to third-party websites or services that are not owned or controlled by us. These links are provided for convenience only, and we are not responsible for the content or practices of these external services.

6.2 No Liability for Third-Party Services

We are not responsible for the content, privacy policies, or practices of any third-party websites or services. Use of such services is at your own risk and subject to their respective terms.

6.3 Third-Party Terms

Use of third-party services is subject to their own terms and conditions. We encourage you to review those terms before using any third-party service integrated with our App.


7. Limitation of Liability

7.1 No Warranties

The App is provided "as is" without any warranties. We do not guarantee the accuracy, reliability, or availability of the App or its services.

7.2 Limitation of Damages

We are not liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the App, including any data loss or loss of access to the App.


8. Changes to Terms of Service

8.1 Right to Modify

We reserve the right to modify these Terms of Service at any time. You will be notified of significant changes through the App or via email.

8.2 Effective Date of Changes

Changes become effective when you actively accept them upon logging into the App. You will be unable to access the App until you accept the revised Terms.

8.3 Acceptance of Changes

If you do not agree to the revised Terms, you will not be able to access the App. You may delete your account at any time.


9. Dispute Resolution

9.1 Informal Resolution

In the event of any dispute arising out of or in connection with these Terms of Service, you agree to first attempt to resolve the dispute informally by contacting us at support@faser.app.

9.2 Mediation

If a dispute cannot be resolved informally, it will be resolved through mediation before taking legal action. Mediation will take place in Germany.

9.3 Online Dispute Resolution

The European Commission provides a platform for online dispute resolution (OS platform), which you can find at https://ec.europa.eu/consumers/odr. We are not obligated to participate in dispute resolution proceedings before a consumer arbitration board.


10. Governing Law

10.1 Jurisdiction

These Terms of Service are governed by the laws of Germany, where the provider of the App is based. Any legal proceedings arising from or related to these Terms will be brought in the courts of Germany.


11. Feedback and Suggestions

11.1 Voluntary Feedback

Any feedback, comments, or suggestions you may provide regarding the App are entirely voluntary. We appreciate your input, which helps us improve our services.

11.2 Rights to Feedback

We are free to use any feedback without any obligation to you, including without limitation, improving the App and its features.


12. NSFW Content Policy

12.1 Definition of NSFW Content

NSFW ("Not Safe For Work") content refers to material that is explicit, graphic, or otherwise inappropriate for general audiences, including but not limited to sexual, violent, or otherwise sensitive content. Not all NSFW subcategories are treated equally under these Terms; some are strictly prohibited while others are permitted under the conditions below.

12.2 Prohibited Human Nudity and Sexual Content

Uploading photographs, videos, or any other content captured by a real camera that depicts nude individuals, sexual acts, or pornographic material involving real human beings is strictly prohibited on the platform. This prohibition applies regardless of whether the content is labeled as NSFW.

12.3 Permitted Stylized and Animated Content

Stylized, animated, computer-generated, or artistic content is permitted as NSFW, including depictions of real or fictional individuals, provided the content is not a photograph or video recorded by a real camera. Such content must always be labeled as NSFW.

12.4 Posting NSFW Content

If you intend to post permitted NSFW content, you are required to clearly mark it by checking the "NSFW" checkbox when creating your post. Failure to label NSFW content appropriately may result in the removal of the content and/or suspension of your account.

12.5 Visibility and Restrictions

NSFW content will only be visible to users who have enabled viewing such content in their settings. Users under the age of 18 are prohibited from accessing NSFW material.

12.6 Compliance and Responsibility

It is your responsibility to ensure that any NSFW content complies with these Terms of Service and applicable laws. We reserve the right to review and remove content that is mislabeled or violates our policies.

13. AI-Generated Content Policy

13.1 Definition of AI-Generated Content

AI-generated content refers to any material (text, images, or media) created, in part or entirely, using artificial intelligence tools or models.

13.2 Mandatory Disclosure

If you post content that has been generated using AI tools, you are required to enable the "AI-Generated" toggle when creating the post. This ensures transparency for all users.

13.3 Failure to Disclose AI-Generated Content

Failure to properly label AI-generated content may result in content removal, temporary suspension, or other actions taken against your account.

13.4 Compliance Responsibility

It is your responsibility to ensure AI-generated content complies with these Terms of Service and all applicable laws. Misleading or mislabeled AI content will not be tolerated.
